Terms and Conditions
1. Our Contract
1.1 In these conditions 'we', 'us' and 'our' refer to Peter Robbins Ltd (company no. 3920928). Easydec.co.uk is the website for Peter Robbins Ltd. You can write to us at Unit 8, Gordleton Industrial Estate, Hannah Way Lymington, SO41 8JD or send e-mail to email@example.com. These are also the addresses to write to if you have any complaints. 'You' and 'your' refer to the customer who places an order with us.
1.2 We reserve the right not to accept any order. Your order is accepted by us on delivery of the goods to you at which point a contract will come into force. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.
2. Price & Payment
2.1 Every effort is made to ensure that our prices and descriptions are accurate. If an error is found or if manufacturer's products change, we will inform you as soon as possible and offer you the option of cancelling your order or reconfirming your order with the revised price or product. We are under no obligation to provide goods to you at an incorrect price.
2.2 On occasion, the prices of goods advertised on our web site may differ from those prices offered at our trade counters. We are under no obligation to honour any web site price if there is such a difference.
2.3 We will require full payment for the goods before we despatch them or prepare them for collection, unless we agree otherwise in writing with you. However, if you have an account with us, payment shall be made in full at the end of the month following the date of invoice. If you are an account customer you are also bound by the terms and conditions agreed on opening your account.
3. Delivery & Title
3.1 All the goods that we supply will remain our property until you have paid for them in full, including all delivery charges. If you sell the goods you agree to hold the sale proceeds upon trust for us until you have paid us for them in full.
3.2 Unless you order and collect the goods from one of our trade counters, we will deliver them in accordance with your order. A valid signature will be required on collection or delivery. In the unlikely event that you have not received all the goods within the stated delivery time, you must notify us immediately. We will not be liable for any delay in delivering the goods which is due to events or circumstances beyond our reasonable control or for any business losses.
3.4 For reasons of health and safety and to avoid any property damage, large or heavy items can only be delivered to a ground floor location at the delivery address. You must therefore make your own arrangements at your own risk if the relevant item needs to be transported from the delivery location.
4. Cancellation & Returns
4.1 You can cancel your order for any reason and get a full refund at any time before you receive the goods, or within 30 days of receipt of the goods. You can cancel your order by letter, email, fax or in person at one of our trade counters. You must return the goods to us in re-saleable condition and at your cost. If you do not return the goods as required, we may charge you the costs of recovering them ourselves.
4.2 This right to cancel your order does not apply to tinted paints, wallpapers, coving products or any other goods which have been made to your specifications or have been specially ordered.
4.3 If you are cancelling because of any problem with the goods, please notify us of the problem at the time of cancellation. Where goods are being returned because they are faulty we will meet the cost of return but we ask that you allow us to arrange collection. When there is a problem with the goods we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.
5.1 We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.
5.2 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
5.3 You will be responsible for any loss or damage to the goods which occurs after they have been delivered to you.
5.4 The information and advice contained on our website and in our sales documentation is for general guidance purposes only. You are responsible for determining whether it applies to your particular situation. In particular, please read all safety instructions provided with our goods, and follow them carefully at all times.
6. Age Restricted Goods
Where you place an order for age-restricted goods such as solvents and knives, you confirm that you are over the age of 18 and that delivery will be accepted by a person over the age of 18. We reserve the right to cancel your order if we reasonably believe you are not legally entitled to order certain goods.
We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.
8. Force Majeure
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
If we fail to enforce any of these conditions, that does not mean that we have waived any of our rights and we retain the right to enforce any of these conditions at any time. English law shall apply to these conditions.
